1. Agreement to Terms
By downloading, installing, or using MurmurTone ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.
"We," "us," and "our" refer to MurmurTone and its developers. "You" and "your" refer to the user of the Software.
2. License Grant
2.1 Free Trial
We grant you a limited, non-exclusive, non-transferable license to use the Software for a 14-day evaluation period ("Trial Period"). During the Trial Period:
- All features are unlocked
- No credit card is required
- Usage is unlimited
- The trial cannot be extended or reset
2.2 Pro License
Upon purchasing a Pro license, we grant you a limited, non-exclusive, non-transferable license to use the Software on your personal computers for as long as your subscription is active. The Pro license:
- Covers one (1) user
- May be used on multiple machines owned by you
- Is billed annually at the rate in effect at time of purchase
- Includes all feature updates during the subscription period
- Locks in "Early Access" pricing for the lifetime of your subscription (as long as you maintain continuous subscription)
2.3 License Restrictions
You may NOT:
- Share, sell, rent, lease, or sublicense your license to others
- Use one license for multiple users or in a commercial/enterprise setting without appropriate licensing
- Reverse engineer, decompile, or disassemble the Software
- Remove or alter any proprietary notices or labels
- Use the Software for any illegal purpose
- Redistribute the Software or its components
3. Pricing and Payment
3.1 Current Pricing
The current Pro license price is $49 per year (USD). This is "Early Access" pricing and may increase for new customers in the future.
3.2 Price Lock Guarantee
If you purchase during the Early Access period, your renewal rate is locked at $49/year for as long as you maintain a continuous subscription. If you cancel and later resubscribe, you will pay the then-current rate.
3.3 Payment Processing
Payments are processed by Polar, our merchant of record (powered by Stripe). By purchasing, you also agree to Polar's terms of service. We never receive, store, or process your payment card information directly. All payment data is handled securely via Polar's hosted checkout.
3.4 Automatic Renewal
Pro licenses automatically renew annually unless cancelled. You can cancel at any time through your payment account or by contacting support. Cancellation takes effect at the end of your current billing period.
4. Refund Policy
If you're not satisfied with MurmurTone within 30 days of purchase, contact us for a full refund. No questions asked.
4.1 Refund Eligibility
- Within 30 days: Full refund available for any reason
- After 30 days: Refunds considered on a case-by-case basis for technical issues we cannot resolve
- Renewal charges: Refundable within 7 days if you forgot to cancel
4.2 How to Request a Refund
Email support@murmurtone.com with your order number or the email used for purchase. Refunds are typically processed within 5-7 business days.
5. Software Updates
We may release updates to the Software from time to time. Updates may include bug fixes, new features, or changes to existing features. Your Pro license includes all updates released during your subscription period.
We reserve the right to discontinue the Software or any features with reasonable notice. If we discontinue the Software entirely, we will provide prorated refunds for unused subscription time.
6. Support
Support is provided via email at support@murmurtone.com. We aim to respond to all inquiries within 2 business days. Support includes:
- Help with installation and setup
- Troubleshooting technical issues
- Guidance on using features
- License activation assistance
Support does NOT include:
- General computer troubleshooting
- Issues caused by third-party software
- Custom feature development
7. Intellectual Property
MurmurTone and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
The Software incorporates open-source components which are subject to their respective licenses. These components remain the property of their respective owners.
8. Disclaimer of Warranties
The Software is provided "as is" without warranty of any kind.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties that the Software will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy of transcriptions
Speech recognition accuracy depends on many factors including microphone quality, background noise, accent, and speech clarity. We do not guarantee any specific level of accuracy.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data
- Loss of business opportunities
- Damages resulting from transcription errors
Our total liability for any claims arising from your use of the Software shall not exceed the amount you paid for the Software in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the Software
- Your violation of these Terms
- Your violation of any third-party rights
11. Termination
11.1 By You
You may stop using the Software at any time. You may cancel your Pro subscription at any time through your payment account or by contacting support.
11.2 By Us
We may terminate or suspend your license immediately if you:
- Violate these Terms
- Share your license key with others
- Attempt to circumvent licensing restrictions
- Use the Software for illegal purposes
Upon termination, your right to use the Software ceases immediately.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by:
- Updating the "Last Updated" date
- Displaying a notice in the Software
- Sending email to Pro license holders
Continued use of the Software after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Missouri, United States.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Software and supersede any prior agreements.
